Terms and Conditions of the Online Store TAFENT.com
I. Definitions
The terms used in these Terms and Conditions mean:

Client – a natural person, legal entity, or organizational unit without legal personality, to which specific provisions grant legal capacity, who places an Order within the Store;

Civil Code – the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);

Terms and Conditions – these Terms and Conditions for the provision of electronic services within the online store TAFENT.COM;

Online Store (Store) – the online service available at https://www.tafent.com/, through which the Client can place Orders;

Goods – products presented in the Online Store;

Sales Agreement – a sales agreement of Goods within the meaning of the Civil Code, concluded between https://www.tafent.com/ and the Client, using the Store’s online service;

Consumer Rights Act – the Act of May 30, 2014, on consumer rights (Journal of Laws of 2014, item 827);

Act on the Provision of Electronic Services – the Act of July 18, 2002, on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);

Order – a declaration of the Client's intent aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Goods.
II. General Provisions

These Terms and Conditions apply to all orders placed by the Client with Szymon Wiśniewski TAF and FIRMA USŁUGOWA MAWI MARCIN WIŚNIEWSKI on the company’s website https://www.tafent.com/.

These Terms and Conditions constitute the regulations referred to in Article 8 of the Act on the Provision of Electronic Services.

By using the website https://www.tafent.com/ and/or placing an order, you accept these Terms and Conditions (“Terms”). Please read the Terms and Conditions before placing an order.

Using the online store is possible provided that the Client's IT system meets the following minimum technical requirements: a device with internet access.

To use the online store, the Client must independently obtain access to a computer or other terminal device with internet access.

In accordance with applicable legal regulations, TAFENT.COM reserves the right to limit the provision of services via the Online Store to individuals under the age of 18. In such cases, potential Clients will be notified.

The availability of products and services on the TAFENT.COM website at any given time does not indicate or guarantee that these products and services will always be available. We reserve the right to withdraw any product from sale at any time.

III. Rules for Using the Online Store
1. The Client can place an order without registering in the Store, after reviewing and accepting these Terms and Conditions. A condition for using the online store at https://www.tafent.com/ is agreeing to the content of the Terms and Conditions and providing the personal data marked as mandatory. TAFENT.COM may revoke the Client’s right to use the Online Store or restrict access to part or all of its resources with immediate effect if the Client violates the Terms and Conditions, especially in the following cases:
>The Client provided false, inaccurate, outdated, misleading, or third-party-infringing data during the registration process in the online store;
>The Client violated the personal rights of third parties through the online store, especially the personal rights of other online store customers;
>The Client engaged in other behaviors deemed by TAFENT.COM as non-compliant with applicable laws, the general principles of internet use, or actions that damage the reputation of TAFENT.COM.
A person who has been deprived of the right to use the online store may not make further purchases without prior consent from TAFENT.COM.
2. In order to ensure the security of communication and data transmission related to the services provided through the Website, the Online Store takes technical and organizational measures appropriate to the level of threat to the security of the services provided, particularly measures aimed at preventing unauthorized access to and modification of personal data transmitted over the Internet.
3. The Client is obliged, in particular, to:
>Not to provide or transmit content prohibited by law, e.g., content promoting violence, defamatory content, or infringing upon the personal rights and other rights of third parties;
>Use the Online Store in a manner that does not disrupt its operation, particularly by using specific software or devices;
>Not to engage in actions such as sending or posting unsolicited commercial information (spam) within the Online Store;
>Use the Online Store in a manner that does not cause inconvenience to other clients or to TAFENT.COM;
>Use all content published within the Online Store solely for personal use;
>Use the Online Store in compliance with the provisions of the law applicable in the territory of the Republic of Poland, the provisions of these Terms and Conditions, and the general principles of using the Internet.
IV. Procedure for Concluding a Sales Agreement

To conclude a Sales Agreement through the Online Store, you must visit the website https://www.tafent.com/, register, and follow the subsequent technical steps based on the messages displayed to the Client and the information available on the site.

Placing an order by registered Clients of the Online Store involves adding the relevant goods to the online shopping cart. Once all items of interest are in the cart, the Client must place the order by selecting the payment method and the delivery option.

During the order placement, the Client is required to provide truthful information.

To send the Order, it is necessary to accept the content of the Terms and Conditions, provide the mandatory personal data, and press the button confirming the submission of the Order.

Information about the Goods provided on the pages of the Store constitutes an offer, within the meaning of Article 66 of the Civil Code. Sending the Order by the Client constitutes a declaration of intent to enter into a Sales Agreement with TAFENT.COM, in accordance with the content of the Terms and Conditions. The Agreement is considered concluded at the moment the Client's Order is received by the Online Store’s IT system, provided the Order complies with the Terms and Conditions. After concluding the agreement, the Client receives an email containing confirmation of all essential elements of the Order.

If we have already received payment for such an order, we will attempt to refund the paid amount using the same method that was used for the payment.

The Seller will proceed with the fulfillment of the Order after confirming the placed order.

The Client may cancel or modify the placed order by: a) contacting the Seller by phone; b) contacting the Seller by email;

Orders are processed by the Customer Service department of the online store on business days, i.e., from Monday to Friday, excluding public holidays, from 11:00 AM to 4:00 PM.
V. Personal Data
1. Filling in the data in the Order Form is equivalent to expressing consent to the processing of the Client's personal data by the Seller and by entities authorized by the Seller to manage the content of the website, of which the Online Store is an integral part, in accordance with the Act of August 29, 1997, on the Protection of Personal Data (Journal of Laws of 2010, No. 229, item 1497, as amended). The personal data provided by clients will be treated in accordance with our Privacy Policy. The data will be processed for the purpose of fulfilling the placed order, including issuing invoices and conducting financial reporting. This data is confidential and will not be disclosed to unauthorized persons. The Client may access their provided personal data and information about placed orders at any time.
2. The administrator of personal data is TAF Szymon Wiśniewski, based in Pomellen 8a, 17329 Nadrensee, VAT ID: DE365524287.
3. The Client's personal data is protected by the Data Administrator in accordance with the provisions of the aforementioned Act on the Protection of Personal Data and will not be transferred, sold, or lent to other persons or institutions that are not authorized to receive it. The Client's personal data will be made available to fulfill the sales agreement for the Products covered by these Terms and Conditions.
4. A Client who has filled out the order form has the ability to access their personal data for verification, modification, or to request its deletion from the personal data database by notifying the Data Administrator in writing at the address: info@tafent.com.
VI. Delivery

The delivery of ordered goods is carried out to the address provided by the Client during the Order placement. We deliver orders within Poland as well as to EU countries and outside the EU.

Delivery of ordered Goods is performed via courier companies DPD, DHL, and InPost parcel lockers.

It is possible to collect the goods in person after prior consultation with the store staff.

Delivery is free for orders valued at least 800 PLN when selecting the prepayment option.

The shipping cost depends on the payment method, order value, and delivery country.

Each shipment is additionally insured and typically arrives at the specified address the day after it is dispatched from the warehouse.

Orders are processed and delivered within 48 hours from the receipt of the order and only on business days.

The Client has 2 days (48 hours) to pick up the order from the InPost parcel locker. The parcel lockers are available 24 hours a day, 7 days a week. To open the locker, the numerical code or QR code received via SMS must be used.
9. Clients can access these Terms and Conditions at any time through the link provided on the homepage of the website https://www.tafent.com/ and can download and print it. The consolidation, securing, sharing, and confirmation of significant provisions of the Sales Agreement for the Goods occur by sending an email to the Client at the provided email address and by including a printout of the confirmation, order specification, and VAT invoice in the shipment containing the Goods
VII. Receipt of Goods

The Seller informs that Clients have the right to check the condition of the shipment upon delivery to the location specified in the order. The inspection of the shipment's condition must be conducted before receiving it from the carrier.

If, before the delivery of the shipment, it is found to be damaged or missing items, the carrier is obliged to immediately establish a protocol regarding the condition of the shipment and the circumstances surrounding the damage. However, in most cases, the carrier performs these actions at the request of the person authorized to receive the shipment.

Please note that if, after the shipment has been handed over, you notice any missing items or damage that is not visible externally, you have the right to request the carrier to assess the condition of the shipment immediately after the damage is discovered, but no later than 7 days from the receipt of the shipment.

VIII. Colors and Dimensions
We strive to present our products, their composition, and colors as accurately as possible. The way colors are displayed depends on the operating system and hardware being used. We cannot guarantee that your computer, monitor, or mobile device accurately reproduces colors.
Actual dimensions may vary depending on the material from which the product is made. We make every effort to ensure that the information on our website is complete, true, and accurate. In the event of errors, TAFENT will promptly make corrections.
IX. Prices and Payment Methods

Under the sales agreement, the Client is obliged to pay the price of the goods indicated in the order and the cost of shipping.

Prices of Goods are quoted in Polish zlotys and include all components, including VAT (with the rate specified). However, the stated prices do not include any potential shipping costs, which will be indicated during the order process.

The delivery cost for each order (excluding wholesale) is the same regardless of the size or weight of the package. The delivery cost is detailed at the finalization stage of the order. The standard delivery cost ranges from 16.00 to 25.00 PLN.

5. The price indicated for each item is binding at the moment the Client places the Order. This price will not change regardless of any price changes in the Online Store that may occur regarding individual goods after the Client has placed the Order.
X. Exchange and Returns (Right of Withdrawal)
Conditions for Exchange/Return
1. A Client who is also a consumer within the meaning of Article 22[1] of the Civil Code of April 23, 1964 (Journal of Laws No. 16, item 93, as amended), who has entered into a distance contract, may withdraw from it without providing any reasons by submitting the appropriate declaration within fourteen (14) days. To meet this deadline, it is sufficient to send the declaration before its expiry. The declaration can be sent:

2. The fourteen-day period in which the Consumer may withdraw from the Sales Agreement or the electronic service contract is counted from the day the Product is delivered in the case of a Sales Agreement, and in the case of a contract for the provision of services by electronic means—from the day it is concluded.
3. The Seller shall promptly send the Consumer an email confirmation of receipt of the declaration of withdrawal from the contract after receiving it.
4. In the event of withdrawal from the contract, the Sales Agreement or the electronic service contract is considered not to have been concluded. The Parties shall return what they have provided in an unchanged condition, unless a change was necessary to ascertain the nature, characteristics, and functioning of the item. The return should occur without delay, no later than within fourteen days.
5. The returned product must not be used or damaged (except for manufacturing defects). There is a possibility to exchange the item for a different model or size. All returned items must be carefully packed and include a properly completed return form. The return form can be downloaded from the website!
6. The Seller shall refund the payments received from the Consumer using the same payment method used by the Consumer, unless the Consumer explicitly agrees to a different method of refund that does not incur any costs for him. The Seller may withhold the refund of payments received from the Consumer until the item is received back or until the Consumer provides proof of its return, whichever occurs first.
7. The postage costs for sending items for exchange or return are borne by the customer. Returns sent at the recipient's expense will not be accepted.

9. The right of withdrawal from a distance contract does not apply to the Consumer in the following cases:
9.1. For the provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who has been informed before the service starts that upon completion of the service by the entrepreneur, they will lose the right to withdraw from the contract.
9.2. In which the price or remuneration depends on fluctuations in the financial market, which the entrepreneur cannot control, and which may occur before the withdrawal period expires.
9.3. In which the subject of the service is a non-prefabricated item produced according to the consumer's specifications or serving to meet their individualized needs.
9.4. In which the subject of the service is an item that is perishable or has a short shelf life.
9.5. In which the subject of the service is an item delivered in a sealed package, which cannot be returned after the package has been opened due to health protection or hygiene reasons if the packaging was opened after delivery.
9.6. In which the subject of the service is items that, due to their nature, become inseparably connected with other items after delivery.
9.7. In which the subject of the service is alcoholic beverages, the price of which was agreed upon when concluding the sales contract, and the delivery may only take place after 30 days, and their value depends on fluctuations in the market, which the entrepreneur cannot control.
9.8. In which the consumer expressly requested the entrepreneur to come to them for urgent repairs or maintenance; if the entrepreneur additionally provides other services than those requested by the consumer or delivers items other than spare parts necessary for carrying out the repair or maintenance, the right of withdrawal applies to the additional services or items.
9.9. In which the subject of the service is sound or visual recordings or computer programs delivered in a sealed package if the packaging has been opened after delivery.
9.10. For the delivery of newspapers, periodicals, or magazines, except for subscription agreements.
9.11. Concluded through a public auction.
9.12. For the provision of accommodation services, other than for residential purposes, transport of goods, car rental, catering, services related to recreation, entertainment, sports, or cultural events, if the contract specifies the day or period of service provision.
9.13. For the delivery of digital content not stored on a tangible medium if the performance of the service has begun with the express consent of the consumer before the withdrawal period expires and after informing them by the entrepreneur about the loss of the right to withdraw from the contract.

XI. Complaints Regarding Products

TAFENT.COM, as the seller, is liable to the Customer who is a consumer as defined in Article 22[1] of the Civil Code, for defects under the warranty as specified in the Civil Code, particularly in Articles 556 and 556[1]-556[3].

Complaints arising from violations of the Customer's legally guaranteed rights or based on these Terms and Conditions should be directed to the address: Pomellen 8a, 17329 Nadrensee, or via email to shop@tafent.com. To expedite and facilitate the complaint process, it is recommended to include any additional information such as the order number, date of sale, etc., with the complaint.

TAFENT.COM commits to addressing each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be processed.
4. The response regarding the complaint will be sent to the address provided by the Customer or in another manner specified by the Customer.
XII. Complaints Regarding Electronic Services

TAFENT.COM takes steps to ensure the full and correct operation of the Store, to the extent that it is possible based on current technical knowledge, and commits to removing any irregularities reported by Customers within a reasonable timeframe.

The Customer is obligated to promptly notify TAFENT.COM of any irregularities or interruptions in the functioning of the Online Store.

Irregularities related to the functioning of the Store can be reported in writing to the address: Pomellen 8a, 17329 Nadrensee, Taf Szymon Wiśniewski, or via email to info@tafent.com.

In the complaint, the Customer should provide their name, correspondence address, type, and date of the irregularity related to the functioning of the Store.

TAFENT.COM commits to addressing each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be processed.
6. The response regarding the complaint will be sent to the Customer's email address or in another manner specified by the Customer.
XV. Additional Information

To avoid any potential discrepancies or errors, it is recommended that the device used by the Customer to access the store https://www.tafent.com/ meets at least the following technical requirements necessary for cooperation with the IT system operated by the Service Provider:

During the order placement process, until the moment the “order with obligation to pay” button or another equivalent phrase is clicked, the Customer has the ability to change the entered data (e.g., type/quantity of goods/delivery method). In the event of discrepancies, the Customer should follow the messages displayed to them and the information available on the Online Store's website and its subsequent pages. If there are any issues or difficulties, please contact us via email at contact@tafent.com.

In the event of an error made by the Customer regarding the entered data (e.g., quantity of ordered goods, incorrect calculation of the Order by the system), it is recommended to send an email to contact@tafent.com.

In matters not regulated by these Terms and Conditions, the provisions of the law applicable in the territory of the Republic of Poland shall apply, including the Civil Code, the Act on Providing Services by Electronic Means of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended); the Act on Consumer Rights of May 30, 2014 (Journal of Laws of 2014, item 827), and other relevant provisions of Polish law.5. Changes to the Regulations:

The Service Provider reserves the right to make changes to these Regulations, of which the Customer will be notified at least 14 days in advance of the date the changes take effect. Information about the changes will also be clearly communicated by posting on the Online Store's website and sent to the email address of the registered customer. Furthermore, the Customer will be asked to accept the new regulations before placing an Order each time.

The amended regulations bind the Customer if the requirements specified in Article 384 of the Civil Code are met (i.e., the Customer has been properly notified of the changes), and the Customer has not terminated the contract for the provision of electronic services of a continuous nature within 30 days.
7. Changes to the regulations will not in any way affect the rights acquired by Customers using the Online Store before the date the changes take effect, particularly they will not affect orders that have already been placed and/or are being processed. In such cases, these orders will be fulfilled under the terms specified in the previous regulations.
8. The Sales Agreement for goods is concluded in accordance with Polish law and in the Polish language.
XVI. Final Provisions

Dispute Resolution: Any disputes arising between TAFENT.COM and a Customer who is a consumer within the meaning of Article 22[1] of the Civil Code shall be submitted to the courts competent in accordance with the provisions of the relevant Civil Procedure Code.

Dispute Resolution for Non-Consumers: Any disputes arising between MINIRAMP.PL and a Customer who is not a consumer within the meaning of Article 22[1] of the Civil Code shall be submitted to the court competent due to the seat of TAFENT.COM.

Applicable Law: In matters not regulated by these Regulations, the provisions of the Civil Code, the Act on the Provision of Electronic Services, and other relevant provisions of Polish law shall apply.
